PKB pair not fired over tax inquiry, court hears

The National Awakening Party (PKB) facing a lawsuit for dismissing two of its members claimed on Tuesday that the axing was completely unrelated to the pair’s support of a special House of Representatives inquiry into the tax office.

The PKB, which has been sued by Lily Wahid and Effendi Choirie, told the Central Jakarta District Court that the pair had neglected their party duties.r />
Anwar Rachman, a lawyer for the party, said they had “neglected and abandoned the PKB” since being re-elected to the House in 2009. He claimed that since then, they had never set foot in the PKB office, failed to attend key events such as the party’s national caucus, and refused to return 40 percent of their House earnings to the PKB, as demanded by the party.

“That’s the money that the party needs to keep running,” he was quoted by the Jakarta Globe as saying.

Anwar rebuffed the plaintiffs’ claim that they had been fired for failing to toe the party line and signing a petition backing the proposed House inquiry into corruption at the tax office.

That petition was eventually defeated in a tight vote by the ruling Democratic Party and some of its partners, including the PKB, and led to calls for dissenting coalition members to get the boot.

Anwar also said that Lily and Effendi had refused to acknowledge Muhaimin Iskandar as the PKB chairman. Lily is the sister of the late former President Abdurrahman “Gus Dur” Wahid, who in 2009 lost control of the party to Muhaimin, his nephew, in a bad-tempered feud.

Shaleh, a lawyer for the two dismissed legislators, said that for the PKB to have recalled them from the House simply because of the tax inquiry vote was unlawful.

“Their support for the House inquiry into the tax mafia scandal was in accordance with the Constitution and should not have been the basis [for their dismissal],” he said.

Hermawi F. Taslim, another lawyer for the pair, said the reasons the PKB gave for their dismissal were merely lies and excuses. “Let me point out that the plaintiffs remain loyal to their constituents, while the PKB has sold out,” he said. “I was the head of the party’s national leadership board for 10 years, so I know.” (dar)
