NU ulema yet to OK syaria banking

NU ulema (Islamic scholars) have not yet had the same opinion on the existence of syaria banking for in practice the Islamic based financial institution has remained problematic.

The syaria banking issue came following a dissenting opinion among participants at a pre-NU congress meeting held by the Maudlu'iyah Waqi'iyah Commission at the Jakarta's Bintang Hotel on Tuesday.<>

Deputy chief of the Indonesian Mosque Management of NU Mukhlas Syarkun considered that in some cases the syaria banking was the same as the conventional one, mentioning "there are syaria violations in the practice of syaria banking".

Mukhlas explained that syaria banking did not recognized what so-called as usury (riba). In the practice of giving credit for instance, he added, guarantee system was still implemented. While at the same time not all people especially the poor could give guarantee to get credit.

"In this regard, the syaria banking is not appropriate with the Islamic law (syar'i) because only the rich able to give guarantee can get credit. While the poor having nothing cannot  give guarantee and get credit," he said.

On the contrary, he agreed with concepts of Grameen Bank in Bangladesh developed by Muhammad Yunus, saying that the financial institution had developed concepts of micro credit, namely providing small-scale credit for the poor unable to get credit from conventional banks.

Grameen bank, Mukhlas said, was different from conventional ones for not using guarantee system. To guarantee the debt payment, the Grameen bank has used a system called as "solidarity group," he said.

"This banking concept is, I think, more appropriate with Islamic the Islamic law than the syaria banking itself because it can help economic condition of the poor including the very poor," he explained.

While different opinion on the sharia banking was also stated by chairman of lawmaking body of the Central Board of Nahdlatul Ulama (PBNU), KH Masyhuri Naim, saying that the syaria banking was generally not opposed to the Islamic law.

Kiai Masyhuri expected the incoming NU congress which will reportedly be held in Makassar in January 2009 would seriously take up issues on syaria economic and banking. (rif)
