Indonesia's Constitution to be model for other Muslim countries

On account of the substantive syariah principles recognizing a political accountability model, Indonesian constitution can be potentially a model for many other Muslim countries.
The statement was made by the Islamic law scholar, Dr. Nadirsyah Hosen at a discussion taking up Islam and state issues at the Association for the Development of Pesantren and Society (P3M)'s headquarters in Jakarta Thursday (27/12)<>
Chairman of the Advisory Council (Rais Syuriah) of the Australian Nahdlatul Ulama Special Branch Board (PCI NU) said that in the 1945 Constitution amendment there was no even the word of Islam or syariah. Instead, both Islam and syariah should be considered as spirit. The Indonesian constitution would be neither an Islamic nor secular state.
"I think, it's obviously close to what called as maqasidus syariah (goals of syariah)," he said, adding that the Indonesian constitution did not talk more about the contents of maqasidus syariah.
He said in moderate Muslim countries, there were two approaches, namely syariah to be formalized and the only source or reference and syariah to be considered only as a spirit. (mkf)
