Amended constitution cannot be applied to incumbent president

Constitutional expert Jimly As`shiddiqie said if the article on the presidential term in the 1945 Constitution was amended it could only be applied to the next president, not the incumbent.

"Should the amendment be carried out it can only be applied to the next president, not the incumbent president," Jimly said here on Wednesday in response to a lawmaker`s idea to amend the constitution to allow President Susilo Bambang Yudhoyono to extend his tenure by a third term.r />
Ruhut Sitompul, a member of the Democrat Party (PD) faction in the House of Representatives (DPR), had earlier stated that he would propose an amendment to the 1945 Constitution to extend the tenure of the president to three terms considering that at present there was no figure who could match President Susilo Bambang Yudhoyono as a national leader.

Jimly said Ruhut`s idea was actually detrimental to President Yudhoyono. "I don`t think the idea will be accepted by the public and it will not benefit Yudhoyono," he said.

He said the idea was Ruhut`s personal discourse and the public should not take it seriously.

"This discourse will not benefit President Yudhoyono in the eyes of the public at home and the international community," he said.

Jimly who is also a former member of the presidential advisory council, said that Indonesia at present needed a stable constitutional system.

"So, we should not change the constitution every so often unless we have an intention to improve it. But I don`t think this discourse is being raised to improve it. It even will change the constitution`s very essence," he said.

He said he was confident Yudhoyono was by no means intending to do it.

In the meantime, Syahbanda Naingolan of the Sabang Marauke Circle organization, said the idea to amend the constitution was an unpopular one.

"Besides being costly, it would also be unpopular in the public eyes," he said. (ant/dar)
